Terms of Use

These Terms cover the APEX Car Finder app and related services (the "Application" or "APEX"), operated by Epic Foundry LLC ("Epic Foundry", "we", "us", or the "Service Provider").
1. About APEX
APEX helps you find and research vehicles through tracked models, listing matches, and AI-assisted analysis. It is a research tool for personal use.
2. Acceptance
Downloading, installing, or using APEX means you accept these Terms and our Privacy Policy. If you disagree, don't use APEX.
3. Eligibility
You must be legally able to enter this agreement. Otherwise, use requires a parent or guardian's involvement and consent where the law allows. APEX isn't intended for children under 13 or a higher minimum age required where you live.
4. Accounts
Sign in with Apple or Google Sign-In to use the main app; Explore Demo offers sample data without an account. Keep your details accurate and your account secure; report suspected unauthorized access to [email protected].
Delete your account anytime through PILOT › Delete Account, or email us for help. The Privacy Policy explains deletion, backups, and retained data.
5. License and ownership
We give you a limited, non-exclusive, non-transferable, revocable license to use APEX on a device you own or control for personal, non-commercial purposes. Epic Foundry LLC and its licensors retain ownership of the app, software, design, and content; APEX Car Finder and its logo are our trademarks. No ownership or trademark rights transfer to you.
Don't copy, modify, redistribute, sublicense, sell, reverse engineer, or extract app source code, or remove ownership notices, except as applicable law permits.
6. Acceptable use
- Don't break laws, infringe others' rights, or submit unlawful content.
- Don't harass sellers or misuse their contact information.
- Don't access accounts or systems without permission or bypass security.
- Don't disrupt APEX or harvest other users' information.
- Don't use unauthorized bots or scrapers to access app content.
7. Your content
Your search criteria and display name ("User Content") remain yours and private to your account. You grant us a worldwide, non-exclusive, royalty-free license to store and process them only as needed to provide APEX, and you are responsible for ensuring they comply with law and others' rights.
8. Tracked models and saved vehicles
A tracked model is saved search criteria that APEX keeps checking; you can edit, pause, resume, or delete it. Save matches to your private shortlist. Sharing a match exposes the listing and analysis highlights through a link, not your identity or private search criteria; deleting your account disables those links.
9. AI automotive intelligence
With your permission, Anthropic (Claude) receives scan photos, tracked-model criteria, and public listings to identify vehicles and produce analyses, summaries, and seller questions. We don't send your name, email, or account identifiers. Withdraw permission in PILOT › Privacy; this pauses active tracked models.
Anthropic normally deletes API inputs/outputs within 30 days, with exceptions for safety, usage-policy enforcement, law, and certain services or agreements. It doesn't train on commercial data by default; feedback or explicit permission can change this. See the linked provider policies in our Privacy Policy.
Match Scores and Deal Scores use APEX's rules, listing data, comparable listings, and AI signals; they are estimates. AI-generated results, including analyses, estimated market values, vehicle/trim identification, deal assessments, and recommendations, are informational and may be incomplete or inaccurate. They aren't mechanical inspections, certified appraisals, warranties, guarantees, or professional advice about condition, authenticity, safety, availability, or value.
10. Third-party listings and data
Listings and data come from external sources; we don't independently verify their accuracy, completeness, legality, title status, condition, availability, history, or seller claims. Listings can change or sell at any time. Before buying, verify details yourself, review vehicle history, and consider a qualified pre-purchase inspection.
APEX doesn't certify vehicles or broker, facilitate, participate in, or guarantee transactions. Displaying a listing doesn't imply our endorsement or a partnership with its source.
11. Third-party services
Opening a listing takes you to the seller's or listing site's own terms and privacy policy. We don't control those services, their content, privacy practices, or availability; use them at your own risk.
12. Availability and updates
We make reasonable efforts to keep APEX available, but outages, maintenance, errors, and updates can interrupt it. We may change or discontinue features and, where feasible, give reasonable advance notice of material changes.
13. Suspension and termination
We may suspend or restrict accounts that breach these Terms, with notice and a chance to resolve the issue where practical, except for serious, repeated, or harmful violations. We may discontinue APEX subject to applicable law. When your account ends, your license ends; provisions intended to survive—including §§5, 10, and 14–17—remain effective.
14. Disclaimers
THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE SERVICE PROVIDER DOES NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. THE SERVICE PROVIDER DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY VEHICLE LISTING, AI-GENERATED ANALYSIS, PRICING ESTIMATE, OR OTHER CONTENT AVAILABLE THROUGH THE APPLICATION.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EPIC FOUNDRY LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE SERVICE PROVIDER'S AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO THE SERVICE PROVIDER IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS (USD $100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.
16. Indemnification
You agree to indemnify, defend, and hold harmless Epic Foundry LLC and its officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Application in violation of these Terms; (b) your User Content; or (c) your violation of any applicable law or third-party rights.
17. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles.
Any dispute arising from these Terms or your use of the Application that cannot be resolved informally will be resolved by binding individual arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction. You waive any right to participate in a class action or class-wide arbitration.
18. Changes
We'll post updates with a new effective date and give any additional notice required by law. Continued use after changes take effect means you accept them.
